A. Cancellation Policy

Introduction

Consumers have the right to withdraw from a contract in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their independent professional activity.

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods.

E-mail: sale@phantomfurniture.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form below, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event no later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.

You must send back the goods to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

If you fail to return the goods within the 14-day period, you will bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or Early Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and are manufactured on the basis of an individual choice or decision by the consumer or are clearly personalized.

The right of withdrawal does not apply to consumers who, at the time of concluding the contract, are not citizens of a Member State of the European Union and whose sole place of residence and delivery address are located outside the European Union at the time of concluding the contract.

Related / Financed Transactions

If you finance this contract with a loan and subsequently withdraw from it, the loan agreement shall also cease to bind you, provided that both contracts form a single economic unit. This is particularly likely if we are also your lender or if your lender makes use of our cooperation in financing. If the loan has already been disbursed to us at the time the withdrawal or return of goods becomes effective, your lender shall assume our rights and obligations under the financed contract with regard to the legal consequences of withdrawal or return. The latter does not apply if this contract concerns the acquisition of financial instruments (e.g. securities, foreign exchange or derivatives).

If you wish to avoid any contractual obligations as far as possible, exercise your right of withdrawal and also withdraw from the loan agreement if you are entitled to do so.

General Information

  1. Please avoid damaging or soiling the goods. Please return the goods to us in their original packaging, including all accessories and packaging materials. If necessary, please use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage by using suitable packaging.

  2. Please do not return the goods freight collect.

  3. Please note that the above points 1–2 are not a prerequisite for the effective exercise of the right of withdrawal.
